First and foremost, we LOVE to share images with vendors as we know just how important images are in being able to share your work with potential clients! Below is our list of the terms of use for images that relate to commercial use.
Terms of Use
If you just received a link to a gallery or are wanting to use an image from our website, social media, or portfolio, below are the terms of use for any images that are taken by Atlanta Dahlia Photography:
Images are free to use for digital advertising as long as images are tagged to Atlanta Dahlia Photography either in:
Tag (IG: @atlanta_dahlia_photo | FB: @atlantadahliaphoto or Atlanta Dahlia Photo)
Printed Text (If using on your website, credit must be visible directly corresponding to the image used, either in hover text or in the bottom left or right-hand corner.)
Images can be cropped to fit where needed.
Images cannot be altered in color or style, including in the application of a filter.
Images may not be used for any printed advertising without expressed written consent and a specific release from Atlanta Dahlia Photography. As printing is a form of advertising that cannot just simply be ‘taken down’ we do regard this form of advertising a little differently than digital and request for a written print release from couples on a publication-by-publication basis.
By posting images taken by Atlanta Dahlia Photography, you agree that any requests for images to be removed, at any time, and for any reason, will be honored immediately upon request.

q. why do you have terms & Conditions on how images are used?
A. We are the point of contact for image usage and are assigned the copyright responsibilities for images as the ones creating them. We are also the party responsible for maintaining privacy laws as set forth by national and state-level legislature. While we love to share images always, we have to do so in a way that allows us to quickly and effectively handle any requests for changes, alterations, or removals that we may receive, and this is our way of being able to best do so. Our terms of use are designed to protect not only ourselves but also our clients and you as well.
q. how do I download images for use?
A. The gallery link you have been sent will include access to digital-quality images that can be used on social media or your website. Please keep in mind images downloaded individually are sized in a web-friendly size. If you want to download the high-resolution version, you will see an option available when downloading your marked favorites or full gallery.
q. why do you limit allowing images to be used in print advertising/editorials of couples?
A. It’s crucial to give couples the option of having their images used for printed purposes because it is the one form of advertising that makes it very difficult to remove if requested by the couple or a person whose likeness is visible in an image. For this reason, when requests are made for using an image or images for printed purposes, we talk to our couples and any persons who are present in the image to have a release signed specifically for each publication request to ensure they are comfortable with their image being used. This process also ensures that permission to utilize images for advertising has been granted to each party involved. q. I have a clause in my contract with couples that states I can use images for advertising. This provides me with the ability to use the images, correct?
A. No, as couples are not copyright holders, they cannot transfer rights to others. This comes down to copyright law, a set of very defined laws designed to protect creatives from the distribution of creative works without permission or compensation. These laws grant five rights (reproduction, preparation of derivative works, distribution of copies, performing work publicly, and display or work publicly) directly to the creator of a work, and cannot be negated or transferred without the creatives (us) expressed written consent. This means that any copyright requests must be made directly with the copyright holder, which would be us in the case of images captured by Atlanta Dahlia Photography.
q. what is the difference between personal and commercial usage of images?
A. Personal use of images refers to the use of images that are not for commercial gain. For couples, their permission for use provides them unlimited access to use their images to share on social media, print for display in their home, or download to enjoy their digital picture frame or phone. In contrast, commercial use is the use of an image for financial gains, such as for promotion, endorsement, advertising, or merchandising purposes. Examples of commercial use include a branded company website, brochure, advertisement, presentation, or product. As the point of contact in creating an image, we have a massive responsibility to respect our couples and stay aware of ever-changing privacy laws. For this reason, we maintain the commercial rights to all of our images to ensure that, regardless of who makes a request, i.e., guest, couple, or bystander, these requests can quickly and swiftly be honored.
Q. How long do copyright laws apply?
A. Copyright law protects our rights to our images for our lifetime, plus 70 years.
q. what happens if I use images outside of the terms of use above or refuse to take an image down upon request?
A. Failure to remove an image when you receive a takedown request from us can result in fines. These fines typically range from around $8,000 to $10,000 per image and location used.
q. Can I apply a filter to images?
A. No. Please leave images as they are in color and style. This should go for all photos you receive from any photographer, as photographers spend countless hours cultivating the look and style of our images. While the image may not be to your taste, please honor and respect the creative’s time and effort that has been placed in their images.
Q. may I crop images to use where needed?
A. Absolutely! Please feel free to crop images as needed to fit your social media feed or digital publications/website.
q. if the client uses the image on social media, this means the images are public, and I can use them anywhere I want, correct?
A. Not at all. As a business, you are responsible for ensuring that the images you use for commercial purposes (and, therefore, for your financial gain) are those you have been given permission to use. There is a difference between having some financial gain from an image and that of a person sharing an experience, so cover your bases and, in the case of images taken by us, please follow the terms of use above.
Q. in what cases will you not share a gallery with us?
A. While this is incredibly rare, the following is a breakdown of scenarios that would result in a gallery not being shared:
The couple has requested exclusivity for their gallery not to be shared with vendors.
The event or session date occurred two or more years ago.
A vendor has previously used our images to promote their own photography service or an all-inclusive package including photography or has previously violated the terms set forth in our vendor usage terms and conditions.
A vendor has not honored a previous request for image removal.
